Rakso Travel grants you limited, non-transferable permission to use this site in accordance with the terms and conditions of this User Agreement. You may use this site only to make legitimate reservations (Online bookings) or purchases.
You shall not use this site for any other purpose, including but not limited to making speculative, false or fraudulent reservations or transactions, or any reservation or transaction in anticipation of demand.
You may not copy, reproduce, republish, upload, post, transmit or distribute this site or anything found herein, including any data/content, text, graphics, button icons, audio and video clips, digital downloads, data compilations and software, without the prior written permission of Rakso Travel and/or its third party providers and distributors, as the case may be; however, you may download, display and print the content found on this site for your personal and non-commercial use only.
You are strictly prohibited from using any "robot," "spider" or other automatic device, program, algorithm or methodology having similar processes or functionality, or any manual process, to monitor or copy any of the webpages, data or content found on this site.
You shall not transmit or otherwise transfer any webpages, data or content found on this site to any other computer, server, website, or other medium for mass distribution, and in any case you shall not use any of the materials found herein for any commercial enterprise or for any purpose other than your personal use only.

PRIVACY.
12Trip may share the names and basic identifying details of its members and accredited travel agent sub-agents only with partners, third-party suppliers, and distributors directly involved in fulfilling travel services—such as airlines, hotels, consolidators, or system providers.
This information will be disclosed solely to ensure the quality, accuracy, and delivery of services booked through 12Trip. It shall not be released to unrelated third parties, vendors, or organizations outside the supply chain. Any sharing is strictly limited to what is necessary for service assurance and will always observe data privacy principles of transparency, legitimate purpose, and proportionality.
REVIEW OF TRANSMISSIONS.
Rakso Travel may from time to time monitor and review any information transmitted or received through this site and reserves the right to censor, edit, remove or prohibit the transmission or receipt of any information that Rakso Travel deems inappropriate or in violation of these terms and conditions. During monitoring, the information may be examined, recorded or copied, and your use of this site constitutes your consent to such monitoring, examination, recording, copying and review.
You agree that if and when you submit suggestions, ideas, comments or questions or post any other information on this site, you shall be deemed to have granted Rakso Travel and its affiliates a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicenseable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute and display such content in any form, media or technology. Rakso Travel takes no responsibility and assumes no liability for any content posted or submitted by you.

Rakso Travel is not liable for any loss, delay or damage arising as a result of your failure to fully comply with the documentation requirements of the government and tourism authorities of the destinations being offered on this site.
Rakso Travel may use any electronic means to contact the user whenever it is necessary to do so.
Neither Rakso Travel nor its third party providers or distributors warrant that this site, its servers or any e-mail sent from Rakso Travel are free of viruses or other harmful components.
Access to this site is not guaranteed to be uninterrupted and available 24/7. This site is also subject to maintenance, scheduled or unscheduled, and system outages.
Users may be charged fees for using certain services offered on this website; such fees may vary and be adjusted from time to time.

If, notwithstanding the foregoing, Rakso Travel or any third party provider or distributor should be found liable for any loss or damage which arises out of or is in any way connected with any of the above described functions or uses of this site or its content, the liability of RaksoTravel.com and the third party providers and distributors shall in no event exceed, in the aggregate, the greater of (a) the subscription fee and service charge for accessing this site, or (b) US$100.00. In its sole discretion, in addition to any other rights or remedies available to Rakso Travel and without any liability whatsoever, Rakso Travel at any time and without notice may terminate or restrict your access to any component of this site.
INDEMNIFICATION
You agree to defend and indemnify Rakso Travel and its third party providers and distributors and their officers, directors, employees and agents from and against any claim, cause of action or demand (including without limitation legal fees, costs and expenses), brought by third parties as a result of your use of this site.

RELATIONSHIP.
The relationship between Rakso Travel and yourself will be that of independent contractors, and neither of us nor any of our respective officers, agents or employees will be held or construed to be partners, joint ventures, fiduciaries, employees or agents of the other.
GOVERNING LAW, JURISDICTION AND VENUE.
This Agreement shall be governed by the laws of the Republic of the Philippines.
You consent and submit to the exclusive jurisdiction of the proper courts of Makati City, Metro Manila Philippines, in all questions and controversies arising out of your use of this site and this Agreement.
Any claim or cause of action arising from or relating to your access or use of this site must be brought within one (1) year from the date on which such claim or action arose or accrued.
ATTORNEY'S FEES.
If Rakso Travel or its affiliates take any action to enforce this User Agreement and these terms and conditions, such parties will be entitled to recover from you, and you agree to pay, all reasonable and necessary attorney's fees and any cost of litigation, in addition to any other relief, at law or in equity, to which such parties may be entitled.
INJUNCTIVE RELIEF.
You acknowledge that a violation or attempted violation of any of this User Agreement and these terms and conditions will cause such damage to Rakso Travel as will be irreparable, the exact amount of which would be difficult to ascertain and for which there will be no adequate remedy at law.
Accordingly, you agree that Rakso Travel shall be entitled as a matter of right to an injunction issued by any court of competent jurisdiction, restraining such violation or attempted violation of these terms and conditions by you, as well as recover from you any and all costs and expenses sustained or incurred by Rakso Travel in obtaining such an injunction, including, without limitation, reasonable attorney's fees. You agree that no bond or other security shall be required in connection with such injunction.
TERMINATION.
Rakso Travel may terminate this User Agreement and/or the provision of any of the services on this site at any time for any reason, including your improper use of this site or your failure to comply with these terms and conditions.
Such termination shall not affect any right to relief to which Rakso Travel and its third party providers and distributors may be entitled, at law or in equity.
ASSIGNMENT.
You may not under any circumstance assign, convey, subcontract or delegate your rights, duties or obligations hereunder.
MODIFICATION OF SITE AND/OR PARTS THEREOF.
Rakso Travel reserves the right at any time to modify, alter, revise or completely eliminate any part, component, module, feature or content of this site whenever it deems necessary or convenient, and without any prior notice to users.
ADDITIONAL TERMS.
Additional terms and conditions may apply to reservations, purchases of goods and services and other uses of specific portions, components or modules of this site, and you agree to abide by such additional or other terms and conditions.
SEVERABILITY.
These terms and conditions shall be deemed severable. In the event that any particular provision is determined by a court of law to be unenforceable or invalid, such provision shall nonetheless be enforced to the fullest extent permitted by applicable law, and such determination shall not affect the validity and enforceability of any of the remaining provisions.
HEADINGS.
The headings used in this User Agreement are included for convenience only and will not limit or otherwise affect the terms and conditions hereof.
ENTIRE AGREEMENT; AMENDMENTS.
This User Agreement constitutes the entire agreement between yourself and Rakso Travel relating to the subject matter hereof.
Rakso Travel reserves the right to amend or modify at any time these terms and conditions or any part thereof, whenever it deems necessary, and without any prior notice to users, and your continued use of this site will be conditioned upon the terms and conditions in force at the time of your use.
It shall be your responsibility to check, from time to time, the User Agreement posted on this site, to ascertain whether the same or any part thereof has been amended, modified or updated.
Your continued use of this site and its facilities shall signify your continuing assent and adherence to the User Agreement and all amendments, modifications and adjustments made thereto from time to time.

Rakso Travel is truly committed to respecting your privacy and we recognize the need to ensure the protection and confidentiality of the personal information you provide to us.
Rakso Travel will ensure that your personal data is administered and protected to the extent required under the Republic Act No. 10173, otherwise known as the “Data Privacy Act 2012 (the “Act”) and other applicable laws, rules and regulations.
CONSENT
By submitting your personal data to Rakso Travel, you consent to our using the personal data and information you have shared for the purpose (the “Purpose”) for which you submitted the same. You further consent to us disclosing the information and personal data you have given to our third-party vendors or suppliers who provide services or functions on our behalf, including but not limited to airline and hotel bookings, credit card processing, business analytics, customer service, marketing, and other related activities.
In addition, by sharing your information to us you further accept, confirm, and agree that: (a)the information you have given to Rakso Travel is complete and accurate; and (b) that your failure to provide complete and accurate information may potentially result in Rakso Travel’s inability to provide you with any of the products and services you have requested from Rakso Travel. In such a case, you agree that Rakso Travel shall not be liable for any damage arising from the said inability.
INFORMATION COLLECTED
Rakso Travel receives and stores the information you provide. This includes information that can identify you (“personal information”), including your first and last name, telephone number, postal and email addresses, fax number, credit card information (such as credit card number, cardholder name, and expiration date). We may also request information about your airline and hotel room preferences, loyalty, frequent flyer and/or car rental program information. While you can choose not to provide information, some information about you is required in order for you to initiate and complete transactions with us.
Rakso Travel may periodically obtain both personal and non-personal information about you from affiliated entities, business partners and other independent third-party sources and add it to its information. Examples of information we may receive include: updated delivery and address information, and demographic information.
INFORMATION USE
We use credit card information (such as cardholder name, credit card number, and expiration date) for the purpose of completing the transactions with us. We use other information about you for the following general purposes: to provide you with the products and services you request; to provide you with travel confirmation and updates; to manage your account, to communicate with you in general; to respond to your questions and comments; to allow us to contact you for customer service, if necessary; to measure interest in and improve our products, services, and website; to notify you by email or post about special offers and travel-related products and services that may be of interest to you; to solicit information from you, including through surveys; to resolve disputes, collect fees, or troubleshoot problems; to prevent potentially prohibited or illegal activities; to enforce the Terms and Conditions of our agreements with you; and as otherwise described to you at the point of collection.
We want to make it easy for you to take advantage of travel-related opportunities. One way we do this is by sending you email messages and/or SMS (short message service) that contain information about your travel-related interests. We believe these email messages and/or SMS will provide you with useful information about travel-related special offers available. You will also receive an email whenever we have an update to any of your information on our records. Please note that you will have the opportunity to choose not to receive these email messages and any such email we send.

RETENTION
After the completion of the Purpose, your personal data may be retained by Rakso Travel for record purposes over a period of time.
DATA PROTECTION
We want you to feel confident about our services and we are committed to protecting the information we collect. While no company can guarantee 100% security, we have implemented appropriate administrative, technical, and physical security procedures to help protect the personal information you provide to us. Only authorized Rakso Travel employees are permitted to access personal information, and they only may do so for permitted business functions. In addition, we use encryption when transmitting personal information that is sensitive to you (e.g., credit card details) between your system and ours, and we employ firewalls and intrusion detection systems to help prevent unauthorized persons from gaining access to your information.
DATA DELETION
Dormant accounts will be evaluated once a year but mandatory deletion will be conducted after 5 years of dormancy. If at any time, you want your personal records to be expunged from our database, you can send us a request via our email: support@raksotravel.com, with the subject “PERSONAL INFORMATION DELETION REQUEST” along with your contact information so that can reach you and verify your identity before proceeding with the data deletion. Please expect a processing period of around 1-2 weeks before the process is finalized since this has to be done manually and verified accordingly.

Any request to withdraw your consent given here or access or correct your personal data may be subjected to such restrictions and conditions as prescribed under the Act.
AMENDMENT OF POLICY
RaksoTravel may amend this Policy from time to time and will make available the updated Policy. Rakso Travel’s rights under this clause shall be in addition to and without prejudice to other rights of disclosures available at law in the Philippines (as may be amended or revised from time to time) or any other statutory provision in other applicable laws and nothing herein shall be construed as limiting any of these other rights.
Notwithstanding anything stated in any other documents that you may have entered into with Rakso Travel, in the event of any inconsistency, the terms of this Policy shall prevail.
This Policy shall be governed and interpreted in accordance with Philippine laws.
This Privacy Policy is effective as of 01 July 2015.
